We wrote these Terms to be read, not avoided. Every section has a plain English summary. If anything is unclear, email [email protected] and we will explain it plainly. RaceFeed was built by an endurance athlete. We are on your side.
1. Introduction and Acceptance
Welcome to RaceFeed. These Terms of Service ("Terms") are a legally binding agreement between you and RaceFeed LLC, a California limited liability company ("RaceFeed," "we," "us," or "our"), governing your access to and use of the RaceFeed mobile application, website at racefeed.app, and all related services (collectively, the "Services").
BY CREATING AN ACCOUNT, SCANNING A QR CODE TO ACCESS THE APP, OR USING THE SERVICES IN ANY WAY, YOU AGREE TO THESE TERMS IN FULL. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
If you are using the Services on behalf of a race organization or other entity, you represent that you have authority to bind that entity to these Terms.
1A. What RaceFeed Is — and Is Not
RaceFeed is a race logging and community platform for adult endurance athletes. It is purpose-built to help athletes record race history, share race experiences, discover new races, and connect with other athletes around shared participation in endurance events.
RaceFeed is not a general-purpose social media platform. RaceFeed is not designed to maximize time spent on the platform. RaceFeed does not employ content ranking designed to maximize session length, emotional engagement, or compulsive use. RaceFeed does not employ autoplay video or notification systems designed to create compulsive checking behavior.
RaceFeed's push notifications are transactional and event-driven. They are sent only when a specific action occurs — such as a like, comment, new follower, or race registration opening. RaceFeed does not use algorithmically timed notifications designed to maximize session frequency. Users have full granular control over every notification type through RaceFeed's notification preferences screen, including the ability to set quiet hours during which no notifications will be sent.
RaceFeed does not conduct internal research on addiction or compulsive use patterns. RaceFeed does not employ design features known to exploit adolescent brain development. RaceFeed is designed for adult athletes who choose to use it as a tool for celebrating and sharing their race experiences.
2. Eligibility and Account Registration
2.1 Age Requirements
You must be at least 18 years of age to use RaceFeed. By creating an account, you confirm that you are at least 18 years old. RaceFeed is intended exclusively for adult users. We do not knowingly collect personal information from anyone under 18 years of age. If we become aware that a user is under 18, we will terminate their account and delete their data promptly.
2.2 Account Accuracy
You agree to provide accurate, current, and complete information and to maintain its accuracy. You are responsible for all activity that occurs under your account, whether authorized by you or not.
2.3 Account Security
You are solely responsible for maintaining the confidentiality of your password. You agree to notify us immediately at [email protected] if you suspect unauthorized use of your account.
2.4 One Account Per Person
You may create only one personal account. Duplicate accounts may be terminated at our discretion. Organizations may maintain one account per race brand.
2.5 Account Inactivity
RaceFeed reserves the right to reclaim usernames or archive accounts inactive for more than 24 consecutive months, with at least 30 days prior notice to the email address on file.
3. User Content, Intellectual Property, and Commercial Data
3.1 You Own Your Content
You retain full ownership of all content you create, upload, post, or share through the Services, including race photos, race results, training logs, reviews, comments, and profile information (collectively, "Your Content"). RaceFeed does not claim ownership of Your Content.
3.2 License You Grant to RaceFeed
By posting or sharing Your Content on RaceFeed, you grant RaceFeed LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and process Your Content solely to operate, provide, improve, and promote the Services. This license does not permit RaceFeed to sell Your Content or use it in ways inconsistent with these Terms. This license ends when you delete your content or account, except where your content has been shared with others who have not deleted it.
3.3 RaceFeed Insights — Aggregate Data License
By using the Services, you agree that RaceFeed may include your public activity data in de-identified, aggregated datasets used to generate RaceFeed Insights. RaceFeed Insights are statistical, aggregate analyses describing patterns across many athletes, never individual records. RaceFeed may license or sell RaceFeed Insights to third parties including race organizers, tourism boards, city governments, sports brands, event sponsors, city planners, and academic institutions.
RaceFeed Insights never include your name, username, email address, individual race history, finish times, training log entries, push notification token, device ID, or any data from activities you have set to private.
3.4 Your Control Over Aggregate Data Contribution
You may opt out of contributing your activity data to RaceFeed Insights at any time by emailing [email protected] with the subject line "Insights Opt-Out." We will remove your data from all future Insights products within 30 days. Opting out does not affect your ability to use any feature of RaceFeed.
3.4a Brand Partnerships and Contextual Recommendations
RaceFeed may enter into commercial partnerships with sports brands, gear companies, nutrition brands, and race technology companies ("Brand Partners"). These partnerships may include sponsored community challenges, contextual gear recommendations on race detail pages, finish card and notification integrations, and aggregate campaign performance reporting. Brand Partners never receive individual athlete data, names, email addresses, or personal information. RaceFeed does not display intrusive banner advertisements, serve behavioral targeted advertising, or share your personal information with Brand Partners.
3.5 Accuracy of Race Results
Race results, finish times, personal records, and other athletic data displayed on RaceFeed are self-reported by athletes and have not been independently verified by RaceFeed. RaceFeed makes no representation as to the accuracy of any athlete-submitted race data.
3.6 Feedback License
If you submit ideas, feature requests, suggestions, or other feedback to RaceFeed, you agree that such feedback is non-confidential and that RaceFeed may use, implement, and commercialize it freely without any obligation to compensate or credit you.
3.7 RaceFeed's Intellectual Property
The RaceFeed name, logo, app design, feed algorithm, Race Story feature, Race Room technology, and all software, text, graphics, and other materials created by RaceFeed are the exclusive property of RaceFeed LLC, protected by US and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
4. Acceptable Use Policy
4.1 You Agree To
- Use the Services only for lawful purposes and in accordance with these Terms.
- Post authentic race results and training data that reflect your actual experiences.
- Treat other athletes, race directors, and community members with respect.
- Maintain the accuracy of your profile information.
4.2 Prohibited Conduct
You agree not to:
- Post false, fraudulent, or fabricated race results or finish times.
- Upload content you do not have the right to share, including copyrighted photos or third-party race materials.
- Harass, threaten, bully, defame, or discriminate against any person or group.
- Post spam, unsolicited promotions, or engage in artificial engagement.
- Impersonate any person, athlete, race organization, or RaceFeed employee.
- Attempt to access, scrape, or harvest data from the Services by automated means without our written consent.
- Reverse-engineer, decompile, or attempt to extract the source code of the RaceFeed application.
- Interfere with or disrupt the integrity or performance of the Services.
- Use the Services to transmit malware, viruses, or any destructive code.
- Use race director dashboard data or athlete information for commercial purposes outside the platform without RaceFeed's written consent.
- Create accounts for the purpose of evading a ban or other enforcement action.
- Claim a race page for an event you do not have authority to represent.
4.3 Content Standards
Your Content must not contain explicit sexual material, graphic violence or gore, hate speech targeting any protected characteristic, content that promotes self-harm or suicide, content that facilitates illegal activity, or personally identifiable information about third parties posted without their consent.
4.4 Enforcement
RaceFeed reserves the right — but not the obligation — to monitor, review, remove, or disable access to any content that we determine, in our sole discretion, violates these Terms or applicable law. Violations may result in content removal, account suspension, or permanent termination, without prior notice and without liability to you.
5. Copyright Policy and DMCA Safe Harbor
5.1 Our DMCA Safe Harbor Status
RaceFeed complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) and has registered a designated DMCA agent with the United States Copyright Office. RaceFeed qualifies for safe harbor protection as an online service provider hosting user-generated content.
5.2 Repeat Infringer Policy
RaceFeed maintains and enforces a repeat infringer policy. Users who are found to have repeatedly infringed the copyrights of others will have their accounts terminated.
5.3 Reporting Copyright Infringement
To submit a DMCA takedown notice, send a written notice to [email protected] (subject line: DMCA Notice) containing: a physical or electronic signature of the copyright owner or authorized agent; identification of the copyrighted work claimed to have been infringed; identification of the infringing material including its URL or location on RaceFeed; your contact information; a statement of good faith belief that the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and you are authorized to act on the copyright owner's behalf.
5.4 Counter-Notice
If your content was removed in error, you may send a counter-notice to [email protected] (subject line: DMCA Counter-Notice) including your name and contact information, identification of the removed content, a statement under penalty of perjury of good faith belief that removal was due to mistake, and consent to jurisdiction of the Federal District Court for the Central District of California.
6. Third-Party Services, Links, and Affiliate Relationships
The Services contain links to external websites and race registration platforms (such as RunSignUp, Race Roster, and Active.com). These links are provided for your convenience only. RaceFeed does not control, endorse, or assume responsibility for any third-party service. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
RaceFeed is not a race organizer. RaceFeed does not organize, sponsor, manage, or operate any race event listed on the platform. RaceFeed does not design race courses, manage race-day logistics, provide medical support, or control any aspect of race operations. Race registration links on RaceFeed direct athletes to third-party registration platforms operated by race organizers. The race organizer — not RaceFeed — is solely responsible for all aspects of the race event including course safety, medical provisions, weather decisions, participant qualification requirements, and compliance with applicable permits and regulations.
Where RaceFeed has an affiliate or commercial relationship with a race registration platform, race registration links on RaceFeed may be affiliate links through which RaceFeed earns a commission when an athlete completes registration. This commission relationship is always disclosed at the point of the link. RaceFeed's commercial relationship with a registration platform does not constitute an endorsement of any specific race event, race organizer, or the safety, quality, or legitimacy of any race.
RaceFeed has no ability to process refunds, cancellations, or transfers for race registrations. All such matters are governed solely by the race organizer's policies and the registration platform's terms of service. If a race is cancelled, postponed, or materially changed, your recourse is with the race organizer and registration platform, not with RaceFeed.
By clicking a race registration link on RaceFeed, you acknowledge that you are entering into a relationship with the race organizer, not with RaceFeed, and that RaceFeed has no responsibility for any aspect of that race event.
Contextual gear recommendations on race pages may also be affiliate links — RaceFeed may earn a commission on purchases you make. The price you pay is not affected by RaceFeed's affiliate relationship.
7. Beta Features and Service Availability
RaceFeed may offer features designated as beta, experimental, or preview. These features are provided as-is, may be modified or discontinued at any time without notice, and carry no uptime or performance guarantee. Your use of beta features is at your own risk. RaceFeed does not guarantee uninterrupted or error-free access to the Services. We may suspend, modify, or discontinue the Services or any feature at any time, with or without notice, without liability to you.
8. Push Notifications and Platform Design
By enabling push notifications on your device, you consent to receiving push notifications from RaceFeed, including race registration alerts, likes, new followers, Race Room mentions, training reminders, and Brand Partner offers relevant to races you have saved.
8.1 Notification Design Principles
RaceFeed's push notifications are transactional and event-driven. A notification is sent when a specific, real event occurs — someone liked your post, commented on your review, started following you, or a race you saved opened registration. RaceFeed does not use algorithmically timed notifications designed to maximize the frequency with which you open the app. RaceFeed does not send notifications designed to create compulsive checking behavior or exploit behavioral patterns.
8.2 Your Notification Controls
You have full granular control over notifications through RaceFeed's notification preferences screen, including:
- Enable or disable all notifications globally.
- Enable or disable specific notification types individually (likes, comments, follows, race alerts, training reminders, sponsored offers).
- Set quiet hours during which no notifications will be delivered, regardless of type.
- Disable notifications entirely through your device's system settings.
Disabling push notifications does not affect your ability to use any other feature of the Services.
8.3 Platform Wellness Commitment
RaceFeed does not track time-on-app for the purpose of increasing it. RaceFeed does not employ content ranking designed to maximize session length, emotional engagement, or compulsive use. RaceFeed does not use autoplay video. RaceFeed does not employ streak mechanics, daily login bonuses, or other design patterns whose primary purpose is to create habitual daily engagement independent of authentic user intent. Athletes use RaceFeed because they race. That is the only engagement loop we are building. Certain Athlete and Elite tier features use third-party AI inference services to generate personalized outputs based on your race history, as further described in our Privacy Policy.
9. Race Organizer Terms
These additional terms apply to race directors, event organizers, and other entities ("Organizers") who claim, manage, or list races on RaceFeed, whether under a free trial or paid subscription.
9.1 Organizer Representations
By claiming a race page, you represent and warrant that you are the official organizer or a duly authorized representative of the race event; all race information you submit is accurate and current; you have authority to bind your organization to these Terms; and you will update your race listing promptly if material details change.
9.2 Organizer Dashboard Data
The RaceFeed organizer dashboard gives you access to aggregated, de-identified insights about athlete engagement with your race listing. Dashboard data is always aggregated and de-identified — you will never see an individual athlete's name, email address, or personal contact information. The minimum threshold for any geographic or demographic breakdown is 10 athletes — if fewer than 10 athletes meet a criterion, that data point is suppressed.
9.3 How Organizers May Use Dashboard Data
Organizers may use dashboard data only for planning and improving their race event, making race marketing decisions, reporting to their own stakeholders, and planning logistics. Organizers expressly agree not to export, sell, transfer, or share dashboard data with third parties; use dashboard data to identify or contact individual athletes; combine RaceFeed data with other sources to re-identify individuals; or use dashboard data for purposes unrelated to their listed races.
9.4 Organizer Responsibility for Race Information
You are solely responsible for the accuracy of all race information displayed on your RaceFeed listing. If your race is cancelled, postponed, or materially modified, you agree to update your RaceFeed listing within 48 hours and notify athletes through the organizer dashboard where available. Race communications sent to athlete lists by Organizers are governed by the Organizer's own privacy practices and applicable law. RaceFeed is not responsible for the content or distribution of Organizer communications sent outside of the RaceFeed platform.
9.5 Athlete Reviews
By claiming a race page, you acknowledge that athletes may post reviews, ratings, and comments about your race. RaceFeed does not moderate reviews for favorability. Organizers may not instruct athletes to post false positive reviews, offer incentives for positive reviews, or request removal of honest negative reviews that comply with our content standards.
9.6 Subscription and Billing
Organizer subscriptions are offered monthly. Paid plans include a 60-day free trial for new accounts. After the trial, subscriptions automatically renew at the applicable plan rate unless cancelled at least 24 hours before the renewal date. RaceFeed reserves the right to change pricing with at least 30 days advance notice. All fees are non-refundable except where required by applicable law.
9.6a Athlete and Elite Founding Member Pricing
Athletes who subscribe to an Athlete or Elite tier during the founding member period at the published founding member rate ("Founding Members") will retain their founding member pricing for the life of their subscription, provided the subscription remains active and is not voluntarily cancelled. If a Founding Member cancels their subscription, the founding member rate is permanently forfeited and reactivation is subject to then-current pricing. Founding member slots are limited — 500 Athlete tier and 200 Elite tier — and are allocated on a first-come, first-served basis. RaceFeed reserves the right to close the founding member program at any time once capacity is reached. Founding member pricing applies to athlete subscriptions only and does not apply to organizer plans.
9.7 RaceFeed's Rights Regarding Race Listings
RaceFeed reserves the right to remove, modify, or delist any race listing that violates these Terms, contains materially inaccurate information, or is determined in our sole discretion to be harmful to athletes or the RaceFeed community.
10. Disclaimers and Limitation of Liability
10.1 Services Provided "As Is"
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RACEFEED DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES ARE LIMITED IN DURATION TO 30 DAYS FROM THE DATE YOU FIRST USED THE SERVICES.
10.2 No Liability for User Content or Race Information
RaceFeed is not responsible for any content posted by users or organizers, including race reviews, training logs, comments, results, or race registration links. We do not endorse, verify, or guarantee the accuracy of any user-submitted or organizer-submitted content. You rely on such content at your own risk. RaceFeed is not a race organizer, does not sell race registrations, and is not responsible for any race cancellation, postponement, or modification.
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RACEFEED LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. IN NO EVENT SHALL RACEFEED'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100.00), OR (B) THE TOTAL AMOUNT YOU PAID RACEFEED IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10.4 Athletic Activity, Race Injury, and Wellness Disclaimer
RaceFeed is a social platform for sharing race experiences. We do not provide training advice, medical guidance, nutrition recommendations, or safety recommendations. Endurance athletics carry inherent risks of injury or death, and your athletic activities are undertaken at your sole risk. RaceFeed is not responsible for any injury, illness, or adverse outcome arising from athletic activities referenced in or facilitated by the Services.
RaceFeed does not organize, manage, or operate any race event. Race registration links on RaceFeed connect athletes directly to race organizers and third-party registration platforms. The race organizer is solely responsible for all aspects of race safety, course conditions, medical provisions, and event management. RaceFeed's affiliate commission relationship with a registration platform does not create any duty of care, endorsement, or responsibility for the race event, the organizer's conduct, or any injury or harm arising from participation in any race.
RaceFeed makes no representation about the mental health effects of using the platform. Athletes are responsible for their own emotional wellbeing and their own decisions about how much time to spend on any digital platform. RaceFeed is not a substitute for professional mental health support. If you find that viewing content on RaceFeed is affecting your mental health, you may unfollow any athlete, adjust your feed filters, or delete your account at any time.
10.5 No Addictive Design Warranty
RaceFeed warrants that it does not knowingly employ content ranking designed to maximize session length, emotional engagement, or compulsive use; autoplay video; notification systems designed to create compulsive checking behavior; or streak mechanics whose primary purpose is to create habitual daily engagement independent of authentic user intent. This warranty reflects RaceFeed's actual design principles and is made in good faith based on our product design decisions as of the Effective Date of these Terms.
11. Indemnification
You agree to indemnify, defend, and hold harmless RaceFeed LLC and its officers, directors, employees, contractors, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: Your Content or any content you submit, post, or share through the Services; your use of the Services or violation of these Terms; your violation of any applicable law or regulation; your violation of any rights of a third party; your athletic activities, including injuries or property damage arising from events referenced on the platform; your use of or reliance on any third-party service or registration platform linked from RaceFeed; and if you are an Organizer, any claim arising from inaccurate race information, race cancellation or modification, or athlete interactions with your race listing.
12. Dispute Resolution and Arbitration
12.1 Informal Resolution First
Before filing any formal claim, contact RaceFeed at [email protected] describing the dispute in detail. We will work in good faith to resolve it within 30 days. This step is a prerequisite to arbitration.
12.2 Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single neutral arbitrator in Los Angeles County, California, or via videoconference. The arbitrator's decision is final and binding.
12.3 Class Action Waiver
YOU AND RACEFEED AGREE THAT EACH MAY ONLY BRING CLAIMS IN YOUR OR ITS INDIVIDUAL CAPACITY — NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
12.4 Opt-Out — Your Choice
You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with subject line "Arbitration Opt-Out" and your full name and account email. Opting out does not affect your ability to use any feature of RaceFeed.
12.5 Exceptions
Either party may seek injunctive or equitable relief in any court for disputes involving intellectual property infringement, unauthorized access, or privacy violations.
12.6 Governing Law
These Terms are governed by California law. For disputes not subject to arbitration, you consent to exclusive jurisdiction in the state and federal courts of Los Angeles County, California.
13. Account Termination
13.1 Termination by You
You may delete your account at any time through Settings. Your profile, posts, and personal information will be removed from public view within 30 days.
13.2 Termination by RaceFeed
We may suspend or terminate your account at any time, with or without notice, for violations of these Terms, conduct harmful to users or the platform, or for any other reason in our sole discretion.
13.3 Effect of Termination
Upon account deletion: your profile and posts will be removed from public access; race reviews may remain in de-identified form to preserve community rating integrity; Race Room contributions may remain as part of the community discussion record; RaceFeed retains records required by law. Your contributed data will be removed from all future RaceFeed Insights products within 30 days.
14. General Provisions
14.1 Changes to Terms
We may update these Terms from time to time. We will notify you by email and in-app notice at least 14 days before material changes take effect. Continued use after that date constitutes acceptance of the updated Terms.
14.2 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and RaceFeed regarding the Services.
14.3 Severability
If any provision is found unenforceable, it will be modified to the minimum extent necessary, and remaining provisions continue in full force.
14.4 No Waiver
RaceFeed's failure to enforce any right or provision will not constitute a waiver. Our rights under these Terms survive any termination.
14.5 Assignment
You may not assign these Terms without RaceFeed's prior written consent. RaceFeed may assign these Terms in connection with a merger, acquisition, or sale of assets.
14.6 Force Majeure
RaceFeed is not liable for any failure or delay in performance arising from causes beyond our reasonable control.
